Terms of Service

These Terms of Service ("Terms") govern your use of our AI-powered sports photo stylization service that transforms athletic photographs into artistic renditions using advanced machine learning models. These Terms are entered into by and between you and Blyzt LLC, a limited liability company organized under the laws of Wyoming, United States.

1) Definitions

    Unless otherwise indicated, the following capitalized terms have the following meanings:

  1. Account – means an individualized user panel serving to access and utilize the Service and/or the Website.
  2. AI Models – means artificial intelligence and machine learning algorithms used for sports photo analysis, style transfer, and artistic rendering.
  3. Company – means Blyzt LLC, a limited liability company organized under the laws of Wyoming, United States.
  4. Content – means sports photographs, images, text, and other materials that Users upload, submit, or generate through the Service.
  5. Credits – means prepaid digital tokens used to access AI processing services, with each generation consuming credits based on complexity and options selected.
  6. Device – means computers, smartphones, tablets, or other electronic equipment capable of accessing web services.
  7. Generated Content – means AI-produced artistic renditions, stylized images, and enhanced versions created from User's original sports photographs.
  8. Guest – means an individual browsing the Website without an Account.
  9. Service – means Blyzt's AI-powered sports photo stylization platform, including the Website, AI processing capabilities, and related features.
  10. Sports Content – means photographs, images, or videos depicting athletic activities, sports events, fitness activities, or related sporting contexts.
  11. Terms – means these Terms of Service, available at https://blyzt.art/terms.
  12. User – means an individual or entity who owns an Account and uses the Service.
  13. User Content – means all Content uploaded, submitted, or provided by Users, including original sports photographs and related materials.
  14. Website – means the web platform located at https://blyzt.art and related subdomains.

    15. The above definitions retain their meaning regardless of whether they are expressed in singular or plural form.

2) Acceptance of Terms

    By accessing or using Blyzt (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. Your use of the Service constitutes acceptance of these Terms and our Privacy Policy.

  1. Legal Capacity: You represent that you have the legal capacity to enter into this agreement and are at least the age of majority in your jurisdiction.
  2. Authority: If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
  3. Updates: We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

3) Service Description

  1. Core Service. Blyzt provides an AI-powered platform that specializes in transforming sports photographs into artistic renditions using advanced machine learning models. Our service allows users to upload sports photos and receive stylized, artistic interpretations through various AI processing techniques.
  2. Target Users. The platform is designed for athletes, sports photographers, teams, coaches, sports enthusiasts, and content creators who want to create unique artistic representations of athletic moments and achievements.
  3. Service Features:
    • Multiple AI art styles and rendering techniques for sports imagery
    • High-resolution output generation suitable for print and digital use
    • Batch processing capabilities for multiple photos
    • Custom style parameters and artistic controls
    • Cloud-based processing with secure data handling
    • API access for integration with third-party applications
  4. Technical Requirements:
    • Supported image formats: JPEG, PNG, WEBP (max 50MB per file)
    • Minimum resolution: 512x512 pixels for optimal results
    • Internet connection required for upload and processing
    • Modern web browser with JavaScript enabled
    • Account registration required for service access
  5. Service Availability. Our service is provided on a best-effort basis. Processing times may vary based on system load, image complexity, and selected AI models. We strive for 99.9% uptime but cannot guarantee uninterrupted service availability.
  6. Beta Features. Some features may be offered in beta or experimental status. These features may have limited functionality, reduced reliability, or may be discontinued without notice.

4) Eligibility & Account

    You must be at least the age of majority in your jurisdiction (or have parental consent where permitted). You are responsible for your account, credentials, and all activities under it.

5) User Content & Sports Photo Requirements

  1. Ownership & Rights. You retain ownership of sports photos and other content you upload ("User Content"). You represent and warrant that you own or have the necessary rights to upload and process all User Content, including rights to any individuals depicted in sports photographs.
  2. Processing License. You grant Blyzt a worldwide, non-exclusive, royalty-free license to host, process, analyze, transform, and display User Content solely to provide our AI sports photo stylization services, including temporary storage for processing and quality assurance.
  3. Sports Photo Specific Requirements:
    • Photos must be of legitimate sports or athletic activities
    • You must have consent from all identifiable individuals in photos
    • Professional sports photos may require additional licensing verification
    • Team logos, branded equipment, or copyrighted materials should be avoided unless you own the rights
  4. Prohibited Content. Do not upload: illegal, harmful, violent, pornographic, defamatory, or copyright-infringing material; photos of minors without parental consent; content that violates privacy rights, publicity rights, or applicable laws; fake or manipulated sports imagery intended to deceive.
  5. Content Moderation. We reserve the right to review, reject, or remove any User Content that violates these Terms or our community guidelines, particularly content inappropriate for AI processing.

6) AI-Generated Sports Art & Intellectual Property

  1. Nature of AI Outputs. AI-generated sports art is provided "as is" without warranties of originality, accuracy, artistic merit, or fitness for any particular purpose. Outputs are algorithmic interpretations and may not perfectly represent the original athletic moment.
  2. Ownership & Usage Rights. You receive a non-exclusive, worldwide license to use AI-generated outputs for personal, commercial, and promotional purposes, subject to these Terms and applicable law. Blyzt retains no ownership claims over outputs generated specifically for you.
  3. Third-Party AI Model Considerations:
    • Some AI models may have their own terms affecting generated content
    • Training data from AI providers may influence output characteristics
    • We cannot guarantee complete uniqueness of generated artistic styles
  4. Your Responsibilities. You are solely responsible for:
    • Ensuring appropriate use of generated sports art
    • Obtaining necessary permissions for commercial use
    • Complying with publicity rights of depicted athletes
    • Respecting trademark and copyright laws in commercial applications
    • Verifying compliance with sports organization regulations if applicable
  5. Quality Improvement & Research. Unless you opt out via account settings or support request, Blyzt may use de-identified, anonymized portions of outputs for AI model improvement, debugging, security, and research purposes. We will never publicly showcase your personal photos or identifiable information without explicit consent.
  6. Attribution & Credit. While not required, we appreciate attribution when you share or publish AI-generated sports art created through our platform.

7) Credits & Payments

  1. Credits do not expire. Purchased credits are prepaid digital tokens that do not expire.
  2. Pricing. Prices may change at any time for future purchases. Tax/VAT may apply.
  3. No refunds. Purchases are non‑refundable except where required by law.
  4. Chargebacks. We may suspend or terminate accounts involved in chargebacks or suspected fraud.
  5. Usage. Each generation deducts credits based on options (e.g., quality tiers). Any free promotional credits may have separate rules.

8) Acceptable Use & Rate Limits

  1. General Obligations. You agree to use our services responsibly and in compliance with all applicable laws, regulations, and these Terms. You are solely responsible for your conduct and any content you submit or generate through our platform.
  2. Prohibited Uses. You may not use our services to:
    • Violate any applicable laws, regulations, or third-party rights
    • Upload content that infringes intellectual property rights
    • Generate or distribute harmful, offensive, or illegal content
    • Create deepfakes or misleading content intended to deceive
    • Process images of minors without proper parental consent
    • Violate privacy rights or publicity rights of individuals
    • Reverse engineer, decompile, or attempt to extract our AI models
    • Scrape, crawl, or systematically download our content
    • Overload, spam, or abuse our systems or infrastructure
    • Create multiple accounts to circumvent usage limits
    • Use automated tools or bots without explicit permission
    • Resell or redistribute our services without authorization
  3. Content Responsibility. You warrant that:
    • You own or have necessary rights to all uploaded content
    • Your content does not violate any laws or third-party rights
    • You have obtained required permissions for commercial use
    • You will not hold us liable for any claims arising from your content
  4. Rate Limits & Fair Use. To ensure service quality and fair access for all users, we implement:
    • Daily and monthly processing limits based on your subscription
    • Concurrent processing restrictions to prevent system overload
    • File size and format limitations for optimal performance
    • API rate limiting for automated integrations
  5. Monitoring & Enforcement. We reserve the right to:
    • Monitor usage patterns to detect abuse or violations
    • Review uploaded content for compliance with these Terms
    • Suspend or terminate accounts for violations
    • Remove or refuse to process prohibited content
    • Report illegal activities to appropriate authorities
  6. Account Security. You are responsible for:
    • Maintaining the confidentiality of your account credentials
    • All activities that occur under your account
    • Immediately notifying us of any unauthorized access
    • Using strong passwords and enabling two-factor authentication

9) Third-Party AI Models & Service Providers

  1. AI Model Providers. Our sports photo stylization service utilizes multiple third-party AI models and machine learning platforms. These include: OpenAI, Google Gemini, and SeeDream. Each provider's terms of service and usage policies may apply to content processed through their models.
  2. Data Processing Partners:
    • Cloud infrastructure providers (AWS, Google Cloud, Azure) for secure storage and processing
    • CDN services for efficient content delivery and caching
    • Payment processors for secure transaction handling
    • Analytics services for performance monitoring and optimization
  3. Third-Party Terms Compliance. By using our service, you acknowledge that your content may be subject to the terms and conditions of our third-party AI providers. We make reasonable efforts to ensure our partners maintain appropriate data protection standards.
  4. Service Availability. Our service depends on third-party AI models and infrastructure. We cannot guarantee uninterrupted availability and are not liable for disruptions caused by third-party service outages or limitations.
  5. Model Updates & Changes. Third-party AI models may be updated, modified, or discontinued by their providers. This may affect the style, quality, or availability of certain artistic rendering options.

10) Data Protection & Security Measures

  1. Data Security. We implement industry-standard security measures to protect your sports photos and personal information during upload, processing, and storage. This includes encryption in transit and at rest, secure API communications, and access controls.
  2. Processing Safeguards:
    • Sports photos are processed in secure, isolated environments
    • Temporary processing files are automatically deleted after completion
    • AI model interactions are logged for security and quality purposes
    • Access to user content is restricted to authorized personnel only
  3. Data Retention. Original sports photos are retained only as long as necessary to provide the service and as required by law. Generated outputs may be cached temporarily for performance optimization. You may request deletion of your content through your account settings.
  4. Incident Response. In the event of a security incident affecting your data, we will notify affected users and relevant authorities as required by applicable law and within reasonable timeframes.

11) Intellectual Property

  1. Our Intellectual Property. We own all rights in our AI sports photo stylization platform, including software, algorithms, branding, documentation, and proprietary AI model configurations. You receive a limited, non-exclusive license to use our services as described in these Terms.
  2. Your Content Rights. You retain ownership of your original sports photos and User Content, subject to the processing license granted to us for service provision.
  3. Service License. You grant us a worldwide, royalty-free, non-exclusive license to use, store, process, and display your User Content solely to provide and improve our AI sports photo stylization services, including model training and quality enhancement.
  4. Feedback & Improvements. You grant us a perpetual, irrevocable, royalty-free license to use any feedback, suggestions, or improvements you provide regarding our service or AI models.
  5. Trademark & Branding. "Blyzt" and related marks are our trademarks. You may not use our trademarks without prior written permission, except as necessary to identify our service.

12) Account Termination & Data Handling

  1. Voluntary Termination. You may discontinue using our services at any time by closing your account through account settings or contacting support.
  2. Termination by Blyzt. We may suspend or terminate your access if you violate these Terms, engage in prohibited activities, or for other legitimate reasons including protecting our services, users, or AI model integrity.
  3. Data Handling Upon Termination:
    • Your sports photos and generated content will be deleted within 30 days unless legally required to retain
    • Unused credits are forfeited upon account termination
    • You may request data export before termination
    • Certain data may be retained for legal, security, or fraud prevention
  4. Survival. Provisions regarding intellectual property, liability limitations, dispute resolution, and data protection survive termination.

13) Disclaimers & Limitation of Liability

  1. Service Disclaimers. Our AI sports photo stylization service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties regarding artistic quality, accuracy of AI interpretations, or fitness for specific purposes.
  2. AI-Specific Disclaimers:
    • AI-generated sports art may not accurately represent original photos
    • Processing times and quality may vary based on image complexity
    • Third-party AI models may produce unexpected or undesired results
    • Generated content may inadvertently resemble existing artworks
  3. Limitation of Liability. To the fullest extent permitted by law, Blyzt will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, reputation, or business opportunities resulting from use of our AI services.
  4. Liability Cap. Our total liability for all claims will not exceed the greater of $100 or the amount you paid us in the 12 months preceding the claim.

14) Modifications to Terms

  1. Updates & Changes. We may update these Terms to reflect changes in our AI services, legal requirements, or business practices. Material changes will be communicated via email or prominent service notice at least 30 days before taking effect.
  2. Acceptance. Your continued use of our services after Terms updates constitutes acceptance. If you disagree with changes, you may terminate your account before the effective date.

15) Governing Law & Dispute Resolution

  1. Governing Law. These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
  2. Dispute Resolution Process:
    • First, contact our support team to resolve disputes informally
    • If unresolved, disputes will be handled through binding arbitration
    • Arbitration will be conducted under American Arbitration Association rules
    • Class action lawsuits are waived; disputes must be individual
  3. Jurisdiction. Any legal proceedings will be conducted in San Francisco, California, and you consent to personal jurisdiction there.
